The new Construction (Design and Management) Regulations 2007 (CDM Regulations) came into effect on the 6th of April 2007. These repealed and replaced the CDM Regulations 1994 and the Construction (Health, Safety and Welfare) Regulations 1996 (CHSWR). There will be only one set of construction management regulations..

As general information, below are the changes to Construction (Design and Management) Regulations that came in to force in 2007.

  1. Projects are separated into 'notifiable' and 'non-notifiable' projects. Notifiable is the same as before. Duty holders involved in non-notifiable projects have the specified minimum obligations. Duty holders involved in notifiable projects have additional requests placed upon them. The provision relating to 5 or more workers on site has been removed.
  2. Domestic projects no longer need be notified, and the provisions for clients, agents and developers have been removed. (In a project, one client may act on behalf of all the clients).
  3. Planning supervisor no longer exists. The role of 'CDM Co-ordinator' has been introduced to both support and counsel the client.
  4. Appointment and need of CDM Co-ordinator or principle contractor for a written health and safety plan now is only applicable to notifiable projects.
  5. Under the regulations duty holders are unable to appoint anyone to 'manage, design or construct' anything unless they are competent or under competent supervision.
  6. Assessment and demonstration of competence has been simplified, (guidance for this is given in the revised ACoP)
  7. Co-operation and co-ordination duties now apply to every person involved. Protective and preventative measures parallel the management regulations.
  8. Client duties have been made more precise. Client must take reasonable steps to make certain that the work can be completed without risks to the health and safety to anyone concerned. Clients must notify designers and contractors as to amount of time for scheduling and preparation of work.
  9. On notifiable projects, no work, other than initial design etc, must begin until the co-ordinator has been appointed. Civil liability exemption has now been removed.
  10. Some definitions have changed, including client, construction phases, construction work, contractor, design, place of work and structure.
  11. One set of construction management regulations replace the CDM regulation and the CHSWR.
